Welcome to AeroTemplicity. These Terms of Service ("Terms") govern your access to and use of the AeroTemplicity website, mobile applications, widgets, newsletters, and any other related services (collectively, the "Services") provided by AeroTemplicity ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and AeroTemplicity. We may modify these Terms at any time, and such modifications will be effective immediately upon posting the revised Terms on our Services. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.

1. Acceptance of Terms

By creating an account, accessing, or using the Services, you affirm that you are at least 13 years of age or the age of legal majority in your jurisdiction, and you agree to be bound by these Terms. If you are accessing or using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case "you" or "your" shall refer to such entity. Our Services are designed for a general audience and are not intended for use by children under 13 without parental supervision. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion. Your agreement to these Terms signifies your understanding and acceptance of all clauses herein, including disclaimers of warranties and limitations of liability.

2. Description of Services

AeroTemplicity provides comprehensive weather forecasting services, including current weather conditions, hourly forecasts, 7-day forecasts, detailed atmospheric data (such as wind speed, humidity, UV index, visibility, pressure, sunrise/sunset times, and air quality index), interactive weather radar/maps, graphical charts, severe weather alerts, weather advisory tickers, weather-based recommendations, and seasonal/travel weather planning insights. We also offer additional content like news articles, user upload features for photos/videos, and (where available) live weather camera feeds. Our Services are intended to provide general meteorological information and insights to assist users in their daily planning and activities. While we strive for accuracy, all information is provided "as is" and for informational purposes only. We continuously work to enhance our Services, which may involve adding new features, modifying existing ones, or discontinuing certain aspects. We do not guarantee uninterrupted or error-free operation of the Services.

3. User Accounts

Some features of our Services may require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during the registration process and keep your account information updated.
• Maintain the confidentiality of your account password and be solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
• Not use the account of another user without permission.
• Not create multiple accounts for abusive or fraudulent purposes.

AeroTemplicity reserves the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof) if any information provided proves to be inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is inaccurate, not current, or incomplete, or if you violate these Terms. We are not liable for any loss or damage arising from your failure to comply with these obligations.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Illegal or Unauthorized Use: Using the Services for any unlawful purpose or in any manner that violates applicable local, national, or international law, including, but not limited to, laws regarding intellectual property, data privacy, and export control.
• Interference with Services: Interfering with or disrupting the integrity or performance of the Services or data contained therein, or attempting to gain unauthorized access to the Services or its related systems or networks. This includes introducing viruses, worms, or any other malicious code.
• Data Scraping: Systematically retrieving data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us. This includes using any robot, spider, scraper, or other automated means to access the Services for any purpose.
• Impersonation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Commercial Use: Using the Services for any commercial purposes without our express written consent, other than as explicitly permitted by the nature of the Services (e.g., viewing advertisements).
• Content Violation: Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Intellectual Property Infringement: Infringing upon or violating our intellectual property rights or the intellectual property rights of others. This includes unauthorized copying, distribution, or creation of derivative works.
• Reverse Engineering: Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
• Security Bypass: Attempting to bypass any measures of the Services designed to prevent or restrict access to the Services or any portion of the Services.
• Spamming: Sending unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or other forms of solicitation.

Any violation of these provisions may result in immediate termination of your access to the Services and may subject you to legal penalties. We reserve the right to investigate and prosecute violations of any of the above to the fullest extent of the law.

5. Intellectual Property Rights

All content, features, and functionality on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), are the exclusive property of AeroTemplicity, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The AeroTemplicity name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AeroTemplicity or its affiliates or licensors. You must not use such marks without the prior written permission of AeroTemplicity.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only, subject to these Terms. This license does not include any right to: (a) resell or make any commercial use of the Services or its Content; (b) collect and use any product listings, descriptions, or prices; (c) make any derivative use of the Services or its Content; (d) download or copy account information for the benefit of another merchant; or (e) use any data mining, robots, or similar data gathering and extraction tools. Any unauthorized use terminates the permission or license granted by AeroTemplicity.

If you upload any content to the Services (e.g., user photos/videos), you grant AeroTemplicity a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify AeroTemplicity for all claims resulting from content you supply.

6. Disclaimers

THE SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES ARE PROVIDED BY AEROTEMPLOCITY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. AEROTEMPLOCITY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AeroTemplicity does not warrant or make any representations regarding the use or the results of the use of the Services in terms of their correctness, accuracy, reliability, or otherwise. The weather information provided is based on data from various sources and forecasting models, which are inherently subject to change and potential inaccuracies. While we strive to provide reliable and up-to-date forecasts, we cannot guarantee their absolute precision or completeness. You acknowledge that any reliance upon the Services and any content accessible thereby shall be at your sole risk.

AeroTemplicity expressly disclaims any responsibility for the accuracy, content, or availability of information found on sites that link to or from the Services. We cannot ensure that you will be satisfied with any products or services that you purchase from a third-party site that links to or from the Services or third-party content on our Services. We do not endorse any of the merchandise, nor have we taken any steps to confirm the accuracy or reliability of any of the information contained in such third-party sites or content. We do not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party, and you hereby irrevocably waive any claim against us with respect to such sites and content.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AEROTEMPLOCITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF AEROTEMPLOCITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
• ANY CONTENT OBTAINED FROM THE SERVICES; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL AEROTEMPLOCITY'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID AEROTEMPLOCITY, IF ANY, IN THE LAST TWELVE MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless AeroTemplicity, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Contributions, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services. This indemnification obligation will survive the termination of these Terms and your use of the Services.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction/Country, e.g., the State of California, USA], without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be exclusively brought in the federal or state courts located in [Your City/County, e.g., San Francisco, California], and you hereby consent to the personal jurisdiction and venue therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

10. Dispute Resolution

Any dispute or claim arising out of or relating to these Terms or the Services (including their formation, performance, or breach) that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.

11. Termination

We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Termination will not relieve you of any obligations arising or accruing prior to termination or limit any liability that you otherwise may have to AeroTemplicity.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The unenforceability or invalidity of any provision shall not affect the validity or enforceability of any other provision of these Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AeroTemplicity regarding the use of the Services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and AeroTemplicity with respect to the Services. Any failure by AeroTemplicity to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. AeroTemplicity may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

15. Feedback

We welcome your feedback, comments, and suggestions for improvements to the Services ("Feedback"). You can submit Feedback by contacting us through the methods provided in the "Contact Us" section. You acknowledge and agree that all Feedback you provide will be the sole and exclusive property of AeroTemplicity, and you hereby irrevocably assign to AeroTemplicity all of your right, title, and interest in and to all Feedback, including all worldwide patent, copyright, trade secret, and other proprietary or intellectual property rights therein.

16. Force Majeure

AeroTemplicity shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
